Description: Tampa, Florida civil rights lawyer represented the Plaintiff who sued the Defendant on an Americans with Disabilities Act violation theory.

"The Americans with Disabilities Act (ADA) is a federal law that prohibits discrimination against individuals with disabilities in all areas of public life, including employment, education, transportation, state and local government services, and public accommodations.

Employment

Under the ADA, employers are prohibited from discriminating against qualified individuals with disabilities in all aspects of employment, including hiring, firing, promotions, training, and compensation. Employers are also required to provide reasonable accommodations to employees with disabilities, unless doing so would create an undue hardship for the employer.

Education

Under the ADA, public and private K-12 schools and universities are prohibited from discriminating against students with disabilities. Schools are required to provide students with disabilities with a free and appropriate public education (FAPE) in the least restrictive environment (LRE). Schools are also required to provide reasonable accommodations to students with disabilities, unless doing so would fundamentally alter the nature of the program or service.

Transportation

Under the ADA, public transportation providers are prohibited from discriminating against individuals with disabilities. Public transportation providers are required to make their vehicles and facilities accessible to individuals with disabilities, and they must provide reasonable accommodations to individuals with disabilities, unless doing so would create an undue hardship for the provider.

State and local government services

Under the ADA, state and local governments are prohibited from discriminating against individuals with disabilities in all of their services and programs. This includes services such as public housing, social services, and law enforcement. State and local governments are also required to make their facilities accessible to individuals with disabilities, and they must provide reasonable accommodations to individuals with disabilities, unless doing so would create an undue hardship for the government.

Public accommodations

Under the ADA, private businesses and organizations that operate public accommodations are prohibited from discriminating against individuals with disabilities. Public accommodations include businesses such as restaurants, hotels, movie theaters, and stores. Public accommodations are also required to make their facilities accessible to individuals with disabilities, and they must provide reasonable accommodations to individuals with disabilities, unless doing so would create an undue hardship for the business or organization.

Enforcement

The ADA is enforced by the U.S. Department of Justice (DOJ) and the Equal Employment Opportunity Commission (EEOC). Individuals who believe that their rights under the ADA have been violated can file a complaint with the DOJ or the EEOC.

The ADA is an important law that protects the rights of individuals with disabilities. It is important for individuals with disabilities to understand their rights under the ADA so that they can take steps to protect themselves from discrimination."
