Description: Joyce McKiver and others sued Murphy-Brown, LLC, a subsidiary of Smith Fields Foods, on a nuisance theory claiming that they were damaged and harmed as a direct result of the operation of Defendants' industrial hog operation close to their homes which denied them the enjoyment of their homes. The thousands of hogs confined in the Defendants' buildings produced offensive smells, noise and other disturbances.
Smith Fields confines thousands of hogs and flushes the waste into holding ponds and then spreads to the waste on fields in the vicinity.
