Description: Valparaiso, IN - John Binkowski, age 22, sued Vincent Holland Grand Island Express, Inc. on auto negligence and respondeat superior theories claiming that he was severely injured and damages as a direct result on being injured in a automobile semi-tractor trailer accident on Indiana Highway 49 in Porter County, Indiana on on March 7, 2015.

Binkowski's vehicle was hit from behind while stopped by a tractor trailer rig driven by Holland which did not brake before hitting Binkowki's car.

Binkowski underwent numerous surgeries and underwent extensive rehabilitation to regain the ability to work and earn a living for himself. Plaintiff worked at a Lowe's Home Improvement store before the accident and was a member of the National Guard. He was eventually able to return to work at Lowe's without restrictions, but testified that he continues to suffer from the injuries that he sustained in the accident. He testified that he underwent 15 surgeries and continues to have cognitive and other problems associated with his injuries.

Plaintiff elicited evidence at trial that Holland was talking on a cell phone or was otherwise distracted when he drove his rig into the rear of Binkowski's car.

Michael Langford. Defendants' attorney, vigorously attacked Plaintiff's damage claims on cross during the two-week trial.

Holland testified that he was traveling 65 mph before the accident and did not notice Binkowski's red car stopped in front of him.

Binkowski testified that he is out of the National Guard and will no longer be able to pursue a career in law enforcement.
