Plaintiff, Eddy Toussaint, brings this employment discrimination action against Defendants, the City of New York (the “City”), the New York City Department for the Aging (“DFTA”), Caryn Resnick, Sal Rullan, Kamlesh Patel, Jack Rizzo, and John and Jane Does, alleging disparate treatment, disparate impact, hostile work environment, conspiracy, and other claims arising under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, et seq.; 42 U.S.C. § 1981; 42 U.S.C. § 1983; 42 U.S.C. § 1985, 42 U.S.C. § 1986; the New York State Human Rights Law (“NYSHRL”), N.Y. Exec. Law § 290, et seq.; and the New York City Human Rights Law (“NYCHRL”), N.Y.C Admin. Code § 8-101, et seq. See Second Am. Compl. (“SAC”) ¶¶ 102-124, ECF No. 79. Specifically, Plaintiff, who is African American, alleges that his promotion within DFTA's Information Technology (“IT”) Unit was denied or delayed because of his race, that he and other African-American employees were not offered equivalent opportunities to gain professional training as non-African-American employees, and that Defendants' promotion policies have a disparate impact on African-American employees.

Outcome: ORDER granting (132 in 20cv9143) Letter Motion for Extension of Time. GRANTED. By October 4, 2023, the parties shall file their letters to the Court, addressing the issues discussed in the Court's order of September 12, 2023, ECF No. 121. SO ORDERED.
