Case Style:

Brittany Rauntae Barnes v. The State of Texas

Case Number: 02-18-00106-CR

Judge: Bonnie Sudderth

Court: COURT OF APPEALS SECOND DISTRICT OF TEXAS FORT WORTH

Plaintiff's Attorney: Joseph W. Spence

Defendant's Attorney: Jerry L. Wood

Description: Appellant Brittany Rauntae Barnes pleaded guilty to state jail felony theft in
exchange for 24 monthsí confinement and now attempts to appeal this
conviction. On April 2, 2018, we notified the parties that the trial courtís
certification of the right of appeal appeared to be defective because based on the
plea admonishments, it appeared that Appellant and the State entered into a
charge bargain and that she had accordingly waived her right to appeal. See
Shankle v. State, 119 S.W.3d 808, 813Ė14 (Tex. Crim. App. 2003). We asked
the parties to provide the court with a copy of an amended certification filed in the
trial court record on or before April 12, 2018.
After the amended certification was filed, we notified Appellant that the
amended certification stated that this is a plea-bargain case and that she has no
right of appeal. We informed Appellant that unless she or any party desiring to
continue the appeal filed with the court a response showing grounds for
continuing the appeal, the appeal would be dismissed. See Tex. R. App. P.
25.2(a)(2), (d), 44.3.

Outcome: Appellant has filed a response, but it does not show grounds for continuing
the appeal. Therefore, we dismiss the appeal.
